Welcome to Moments.

These Terms of Service (“Terms”) govern your use of the Moments application (“Application”). By downloading, installing, or using Moments, you agree to these Terms.

If you do not agree with these Terms, please do not use the Application.

1. About Moments

Moments is a personal memory and timeline application that allows you to create and organize important moments in your life.

The Application allows you to:

Create and manage personal moments.
Add dates, titles, and notes.
Add photographs to your moments.
Browse your moments in a timeline.
Search your saved moments.
Edit or delete moments.

Moments is provided free of charge.

2. Your Content

You retain ownership of the content that you create or add to Moments, including your photographs, notes, titles, and other personal information.

You are solely responsible for the content that you choose to store in the Application and for ensuring that you have the necessary rights to use any photographs or other content you add.

You must not use Moments to store or distribute content that:

Violates applicable laws or regulations.
Infringes the rights of another person.
Infringes copyright, trademark, privacy, or other intellectual property rights.
Contains unlawful, harmful, or fraudulent material.

We do not claim ownership of your personal content.

3. Use of the Application

You agree to use Moments only for lawful purposes and in accordance with these Terms.

You must not:

Attempt to reverse engineer, decompile, or disassemble the Application.
Modify, copy, or redistribute the Application or its components.
Attempt to gain unauthorized access to the Application or its systems.
Use the Application in a way that could damage, disable, overburden, or impair its operation.
Use the Application for any unlawful purpose.

4. Intellectual Property

The Moments Application, including its design, software, graphics, logos, icons, text, and other original content, is owned by or licensed to the developer of Moments and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal use, subject to these Terms.

This license does not give you ownership of the Application or any of its intellectual property.

5. Your Photographs and Personal Content

Moments may allow you to select photographs from your device’s photo library.

You are responsible for the photographs and other content that you add to the Application.

You should only add content that you have the right to use and store.

Moments does not claim ownership of your photographs or personal memories.

6. Availability of the Application

We aim to keep Moments available and functioning properly, but we cannot guarantee that the Application will always be available, uninterrupted, or error-free.

The Application may occasionally be unavailable due to:

Maintenance or updates.
Technical problems.
Operating system changes.
Issues with third-party services.
Circumstances beyond our reasonable control.

We may modify, update, suspend, or discontinue certain features of the Application when reasonably necessary.

7. Updates

We may release updates to Moments from time to time.

Updates may include bug fixes, security improvements, new features, changes to existing functionality, or compatibility updates.

You are responsible for keeping the Application updated when updates are available.

8. Disclaimer

Moments is provided on an “as is” and “as available” basis, to the extent permitted by applicable law.

We do not guarantee that:

The Application will always be available.
The Application will be completely free from errors or interruptions.
The Application will meet every individual requirement.
All information stored by the Application will always remain available.

You should maintain appropriate backups of important photographs and memories that you do not want to lose.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of, or inability to use, the Application.

This includes, where legally permitted, loss of data, photographs, or other personal content.

However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

10. Third-Party Services

Moments may use services provided by third parties, including services provided by Apple, such as iCloud or CloudKit where applicable.

Your use of those services may also be subject to the terms and privacy policies of those third parties.

We are not responsible for the availability, functionality, or policies of third-party services.

11. Links to Other Websites

Moments or this website may contain links to third-party websites.

We are not responsible for the content, availability, or privacy practices of third-party websites.

Visiting third-party websites is at your own risk, and we recommend reviewing their applicable terms and privacy policies.

12. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the top of this page.

Your continued use of Moments after the updated Terms become effective constitutes acceptance of the revised Terms.

13. Termination

You may stop using Moments at any time by deleting the Application from your device.

We may restrict or terminate access to the Application if you materially violate these Terms or if it is necessary for legal, security, or operational reasons.

Upon termination, the provisions of these Terms that by their nature should continue to apply will remain in effect.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Spain, without regard to its conflict of law provisions.

Nothing in these Terms affects any mandatory consumer rights that apply to you under the laws of your country or place of residence.
